These Terms and Conditions (“Terms”) govern your access to and use of the Stackcoderz Hosting website and services operated by Stackcoderz Consulting Group (“Stackcoderz,” “we,” “us,” or “our”). By purchasing, activating, accessing, or using our services, you agree to these Terms. If you do not agree, please do not use our services.

1. About Our Services

These Terms and Conditions (“Terms”) govern your access to and use of the Stackcoderz Hosting website and services operated by Stackcoderz Consulting Group (“Stackcoderz,” “we,” “us,” or “our”). By purchasing, activating, accessing, or using our services, you agree to these Terms. If you do not agree, please do not use our services.

Stackcoderz provides web hosting, WordPress hosting, website-related infrastructure, technical support, migration assistance, security features, and related digital services. The exact features, limits, pricing, and term applicable to your order are those displayed at checkout or in your order confirmation.

2. Eligibility and Account Information

  • You must provide accurate, current, and complete information when placing an order.
  • You are responsible for keeping your account, contact details, and payment information up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out through your account.
  • You must promptly notify us if you suspect unauthorized access or misuse of your account.

3. Orders, Pricing, and Payments

  • All prices, promotional offers, billing periods, and renewal rates are shown at the time of purchase or communicated in your order confirmation.
  • Promotional prices may apply only to the initial term and may renew at the then-current standard rate unless expressly stated otherwise.
  • Services may not be activated until payment and any required verification have been completed.
  • You are responsible for applicable taxes, transaction charges, and other fees associated with your order.
  • We may correct pricing or billing errors and will communicate material corrections where reasonably practicable.

4. Renewals and Expiration

Unless your order states otherwise, hosting services are provided for the term selected at checkout. Renewal may require payment before the next service period begins. You are responsible for monitoring renewal dates and ensuring that payment details remain valid. If a service expires or is not renewed, access may be restricted, suspended, or terminated and associated data may later be deleted.

5. Acceptable Use

You may use our services only for lawful purposes and in a manner that does not harm our systems, network, personnel, customers, or third parties. You must not:

  • Host, distribute, or transmit unlawful, fraudulent, defamatory, abusive, threatening, or infringing content.
  • Distribute malware, ransomware, viruses, phishing pages, or other malicious code.
  • Conduct spam, bulk unsolicited messaging, mail bombing, or unauthorized email campaigns.
  • Attempt unauthorized access, scanning, exploitation, denial-of-service activity, or interference with any system or network.
  • Use hosting primarily as an off-site file archive, backup repository, file-sharing service, or storage platform unrelated to an active website unless expressly permitted in writing.
  • Operate content or applications that materially impair server stability, security, or performance.
  • Violate any applicable local, national, or international law, regulation, or third-party right.

6. Resource Usage and Fair Use

All plans are subject to reasonable resource and security limits, including limits relating to CPU, memory, processes, storage, databases, email activity, inodes, and network usage. If your use threatens service stability or materially affects other customers, we may request corrective action, limit affected processes, temporarily suspend the relevant service, or recommend an upgrade.

7. Website Content and Customer Responsibility

You are solely responsible for the content, applications, software, domains, email communications, and data hosted in your account. You represent that you have all necessary rights, permissions, licenses, and consents for content and software you upload or use. You are also responsible for maintaining appropriate website security, updates, access controls, and independent backups.

8. Backups and Data Loss

Where backups are included, they are provided as a protective feature and not as a guarantee against data loss. Backup frequency, retention, availability, and restoration options may vary by plan. You should maintain independent backups of important files, databases, emails, and configurations. Stackcoderz is not responsible for loss of data resulting from customer actions, software failures, security incidents, suspension, termination, or circumstances outside our reasonable control.

9. Migration Services

Migration assistance may be provided subject to technical compatibility, access credentials, source-server conditions, and available resources. We will use reasonable efforts to preserve website content, but we do not guarantee zero downtime, uninterrupted service, complete compatibility, or preservation of every configuration, plugin, email setting, or search-engine result. You remain responsible for maintaining a current backup before migration.

10. Domains, Third-Party Services, and Software

Domain registration, SSL certificates, control panels, plugins, themes, AI tools, payment services, and other third-party products may be subject to separate terms imposed by their respective providers. You agree to comply with those terms and understand that third-party availability, pricing, functionality, and policies are outside our control.

11. AI-Powered Tools

AI-powered tools may generate recommendations, content, code, diagnostics, or optimization suggestions. AI output may be incomplete, inaccurate, or unsuitable for your specific website. You are responsible for reviewing and approving AI-generated output before implementation. AI tools do not guarantee rankings, security, error resolution, performance results, or business outcomes.

12. Support and Maintenance

We aim to provide support through the channels identified on our website or in your account. Response times may vary depending on issue severity, plan, workload, maintenance windows, and third-party dependencies. Support does not necessarily include custom development, third-party application troubleshooting, malware cleanup, or recovery from customer-caused issues unless expressly included in your plan.

13. Availability and Service Interruptions

We work to maintain reliable service, but hosting availability may be affected by maintenance, upgrades, network outages, cyberattacks, upstream providers, equipment failures, force majeure events, or customer configuration. Any uptime statement or SLA applies only if expressly included in your applicable order or separate service-level agreement, including its exclusions and remedies.

14. Suspension and Termination

We may suspend or terminate services where payment is overdue, these Terms are violated, activity creates a security or operational risk, required information is not provided, or suspension is required by law or a competent authority. Where reasonably practicable, we may provide notice and an opportunity to remedy the issue; however, immediate action may be taken for serious or urgent risks.

15. Cancellation and Refunds

Cancellation, refund eligibility, promotional exclusions, domain fees, setup fees, and service-specific conditions are governed by the applicable refund or cancellation policy communicated at checkout or made available on our website. Cancellation requests should be submitted through the designated support channel before the next billing period where possible. Unless required by law, fees already incurred and third-party charges may be non-refundable.

16. Intellectual Property

Stackcoderz and its licensors retain all rights in our website, branding, text, graphics, software, documentation, and service materials. You retain ownership of your content, subject to the rights reasonably required for us to provide the services. You may not copy, modify, resell, or commercially exploit our proprietary materials without written permission.

Our collection and use of personal information is described in our Privacy Policy. You are responsible for ensuring that your own website and hosted services comply with applicable privacy, data protection, cookie, marketing, and consumer-protection requirements.

18. Disclaimers

Except where expressly stated in writing or required by applicable law, services are provided on an “as available” and “as is” basis. We do not guarantee that services will be uninterrupted, error-free, completely secure, or suitable for every purpose. We do not guarantee specific website traffic, search rankings, conversion rates, revenue, or business results.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Stackcoderz will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, business opportunities, or data arising from or related to the services. Where liability cannot be excluded, our aggregate liability will be limited to the amount paid by you for the affected service during the twelve months preceding the event giving rise to the claim, unless applicable law requires otherwise.

20. Indemnification

You agree to defend, indemnify, and hold harmless Stackcoderz, its affiliates, personnel, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your content, use of the services, violation of these Terms, infringement of third-party rights, or violation of applicable law.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, legal requirements, or operational practices. Updated Terms will be posted on this page with a revised effective date. Your continued use of the services after an update becomes effective constitutes acceptance of the revised Terms, to the extent permitted by law.

22. Governing Law and Disputes

These Terms are governed by the laws applicable to the contracting entity identified in your order, without regard to conflict-of-law principles. Any dispute will be handled through the courts or dispute-resolution process having jurisdiction over the parties, subject to mandatory rights and protections available under applicable law. Confirm the final governing law, jurisdiction, and dispute process with qualified legal counsel before publication.
